SUMMARY of EVENTS
On February 11, 2006, Linda Brown was detained and subjected to an unfair and viscous investigation by two police officers of the Riley County Police Department. In the course of the investigation his eight year old daughter was subjected to unnecessary, unfair, and negligent or outrageous interrogations by the same two police officers. This young child was manipulated and coerced into making a statement against her mother. She was told that she had to change her story to one the police would believe in order to return home, and to stop her mother from getting into trouble. One officer lied to the girl, telling her that her mother had already confessed, which was not true. This same officer at one point implied that if his daughter did not implicate her mother, that she might be blamed for her sister's broken arm. The police were also reckless in asking leading questions and planting details of their theory during the interogation. Every part of Detective Schwartz's police report and affidavit's so called legal evidence can be traced to things the police had told her.The detective lied to parents, and later to attorneys and in written statements, as to both the nature of the interrogation and what was said. The interrogation was brutal, prolonged, and not done in accordance with accepted proceedures for forensic interviewing of children by police. The interrogation was also contrary to known policies and proceedures of how to do forensic interviews of children. Detective Schwartz had been specifically trained by Dr. Helen Swann, Kansas's expert on forensic interview of children. The police also interviewed his younger six year old daughter who had the broken arm. Contrary to their assurances to the parents, this interview was not taped. The conduct of the police officers was, at a minimum, negligent, and also constitutes the tort of outrage. The officers were acting within the scope of their employment as police officers for the Riley County Police Department.

Charges were made against Linda Brown for alleged child abuse. These charges were eventually found to be unfounded, and all legal action against her was eventally dropped. However, before she was cleared her day care license was suspended, resulting in a loss of income, and temporary impoverishment of her family. The children were initially removed from the home. The price the Browns had to pay to get their children back was to surrenduer legal custody of their children to SRS, submit to SRS supervision, and acquiese to the surrender of thier most fundamental rights of privacy by submitting to parental and psychological evaluation, the results of which were to be given to their opponents. This information was misused by SRS for reasons not related to this case. The experience was degrading, highly stressful, emotionally traumatic, and financially devastating to the parents. The stability and emotional security the children had known their whole lives was shattered. We agreed to the conditions presented them by SRS primarily out of fear arising from misinformation given them and their attorneys by the police about Kaylana's interrogation.

The family have suffered pecuniary and nonpecuniary loss, including loss of income, humiliation, mental distress, and expenses for legal fees and counselling for themselves and their child, Kaylana, as well as other loss or damage.

We are publishing the blog and video to help educate the general public on how police and social workers get children to implicate parents when they are falsely accused. There are many families out there who are not as fortunate as we were. They have lost their children for a long time or permanently when these forensics interviews are conducted like this. Also, there is a perjurious police report and affidavit out there by Detective Carla Schwartz who was never fired. Both of the cops, Detective Carla Schwartz and Police Officer Adam Peterson committed a crime in our view, and the law board and RCPD just "circled the wagons." If this makes you angry then pass this video along. Keep in mind the RCPD, who claim in their values statement that their officers have "INTEGRITY Adherence to moral and ethical principles, soundness of moral character, honesty," never apologized and never admited their officers committed perjury or other crimes. If your state does not have good children advocacy centers or laws to protect children when they are interviewed forensically this could happen easily to them.
